Public Offer Agreement

This Public Offer Agreement (“Agreement”) governs the terms and conditions under which individuals (“Participants”) may attend AppGala Conference events. By making a payment for participation, you accept this Agreement in full and enter into a contract with the event organizer.

1. Subject of the Agreement

The organizer undertakes to provide Participants with access to the AppGala Conference event, including event sessions, activities, and materials as specified in the event program.

2. Organizer Obligations

When holding an event, the organizer shall:

  • Ensure a high level of comfort for all participants;
  • Provide necessary equipment and resources for the event;
  • Inform participants of any changes to the schedule or event format in a timely manner;
  • Provide advice and support to participants for event-related inquiries via phone, email, social media, and other available communication channels.

3. Participation and Payment

3.1. A person becomes a Participant of the event only after full payment has been successfully processed.

3.2. Upon payment, the Participant obtains the right to attend the event on the date(s) and under the conditions specified by the organizer.

4. Refund and Ticket Transfer Policy

4.1. All payments for participation in the AppGala Conference are final and non-refundable.
In accordance with the applicable laws of the Republic of Poland and the European Union regarding consumer rights for event-related services, withdrawal from participation, non-attendance, or changes of plans on the Participant’s side do not constitute grounds for a refund.

4.2. The Participant may transfer their right to attend the event to another individual without any additional fees, provided that the organizer is notified via email or phone no later than 96 hours before the event begins.

5. Personal Data Processing (GDPR Compliance)

5.1. In accordance with the Personal Data Protection Act of 10 May 2018 of Poland and the General Data Protection Regulation (GDPR), by accepting this Agreement, the Participant confirms that their personal data is included in the AppGala Conference database and may be processed both electronically and on physical media.

5.2. The Participant provides explicit consent for the processing of personal data for the purposes of fulfilling the organizer’s obligations as a service provider, including communication, event attendance administration, and service delivery.

5.3. This consent remains valid for 20 years unless withdrawn earlier by written request. Upon the Participant’s explicit request, their personal data may be deleted, subject to legal retention requirements.

6. Acceptance of the Offer

By making a payment for participation in the AppGala Conference, the Participant confirms that they:

  • Have read, understood, and agreed to the terms of this Public Offer Agreement;
  • Understand the purpose, scope, and grounds for the processing and transfer of personal data;
  • Acknowledge their rights under GDPR.

7. Governing Law

This Agreement and any legal relations arising from it shall be governed by and interpreted in accordance with the laws of the Republic of Poland and the applicable laws of the European Union.

8. Final Provisions

8.1. The organizer reserves the right to make changes to this Agreement. Updated terms shall apply only to payments made after the publication of the revised text.
8.2. If any provision of this Agreement is deemed invalid, the remaining provisions shall remain in full force and effect.
8.3. Communication between the Participant and the organizer may be conducted in electronic form and shall hold legal force.
